Terms of Service

Please read these Terms of Service ("Terms") carefully before using Signume's services.

Introduction

Welcome to Signume ("Company", "we", "our", "us")! These Terms of Service constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you"), and Moonlab B.V., operating as Signume, located at Nassaukade 159-4, 1053LK Amsterdam, The Netherlands. By accessing or using any part of our services, you agree that you have read, understood, and agreed to be bound by these Terms.

Definitions

"Services" refers to the email identity verification solutions provided by Signume. These include, but are not limited to, BIMI implementation, Verified Mark Certificate (VMC) management, DMARC compliance, and related email authentication services. "User", "you", and "your" refer to the individual or entity that has agreed to these Terms to access and use our Services. "Content" refers to any information, data, text, software, photos, graphics, video, messages, or other materials.

The Services

Signume provides email identity verification services designed to help brands achieve verified status in email inboxes through BIMI implementation, VMC management, trademark filing assistance, and DMARC compliance.

Service Delivery Timeline

The thirty (30) calendar day timeframe referenced on Signume's website and in marketing materials is a good-faith target and non-binding estimate, not a guarantee. Actual delivery time depends heavily on Client cooperation and on third parties outside Signume's control.

The 30-day target assumes, among other things, that the Client: (a) provides timely DNS access (or executes DNS changes Signume specifies) when requested; (b) delivers brand assets, trademark documentation, and authorizations promptly and in usable form; (c) responds to Signume's questions, verification steps, and approval requests within twenty-four (24) hours; (d) completes any internal legal, security, or brand reviews without unreasonable delay; and (e) authorizes any changes Signume requires from the Client's email service provider, registrar, or other vendors.

Any Client delay, incomplete information, lack of access to required systems, or failure to meet the 24-hour response window will extend the timeline by at least an equivalent number of days, and Signume may revise the estimate accordingly. Signume shall not be liable for delays caused by third parties, including but not limited to certificate authorities, email service providers, registrars, domain hosts, and trademark offices (including office actions, examiner queries, and opposition periods). Signume will notify the Client promptly of material third-party delays.

Signume's failure to deliver within thirty (30) days does not constitute a breach of these Terms and does not entitle the Client to any refund, credit, or other remedy.

Performance and Deliverability Disclaimer

Signume's services are designed to help Clients achieve email identity verification (including DMARC compliance, trademark coordination, VMC issuance, and BIMI configuration) and the visible logo and verified checkmark in supporting inboxes. Signume does not guarantee any specific lift in open rates, click rates, conversion rates, revenue, engagement, or other commercial outcomes that may or may not result from these services.

Email deliverability is influenced by many factors outside Signume's control, including but not limited to: sender reputation, list hygiene, content and copy, send frequency and volume, recipient engagement, spam complaint rates, mailbox provider policies and algorithms, IP and domain reputation, email service provider infrastructure, authentication record drift introduced by the Client or third parties, and changes to inbox-provider rendering rules. Signume is not responsible or liable for the Client's overall email deliverability, inbox placement, spam or promotions folder placement, blocklisting, or sender reputation.

Signume's services establish the email identity verification layer (DMARC, trademark, VMC, BIMI) at the point of delivery. Ongoing domain deliverability is the Client's responsibility. Signume does not guarantee, monitor, or remediate deliverability outcomes affected by Client conduct after delivery, including but not limited to: changes to sending practices, list acquisition or purchase, content or copy decisions, send volume or frequency, modifications to DNS or authentication records, switching email service providers without proper migration, ignoring spam complaints or unsubscribe requests, sending to unengaged or purchased lists, mailing to recipients who have not opted in, or any other conduct that damages sender reputation. The verified identity outcome Signume delivers is not a substitute for sound email program practices, and conduct that tanks deliverability is outside Signume's warranty.

Any case studies, statistics, testimonials, or performance figures referenced in Signume's marketing materials reflect specific Client outcomes under specific conditions, are not representative or predictive of results any other Client will achieve, and do not constitute a warranty or representation of future performance.

Mailbox Provider Display and Support

Whether, when, and how a brand logo or verified checkmark is displayed in any given inbox is determined solely by each mailbox provider (including but not limited to Google, Yahoo, Apple, and Microsoft), not by Signume. Each provider independently decides whether to support BIMI at all, which certificate types it honors, and what additional eligibility criteria apply, including sender reputation thresholds, engagement levels, sending volume, caching behavior, and staged rollouts.

Some mailbox providers do not support BIMI or logo display at all, and others support it only partially, inconsistently, or for certain account types, devices, applications, or operating system versions. Display may also vary based on a recipient's individual settings, application version, or a provider's internal experiments, and may appear, disappear, or change without notice. Logo and checkmark display in any specific inbox, for any specific recipient, on any specific device, at any specific time is expressly not guaranteed.

Signume's deliverable is the correct implementation of the underlying verification layer (DMARC compliance, trademark coordination where applicable, VMC issuance, and BIMI configuration) in accordance with published standards. Once that layer is correctly implemented, rendering decisions rest entirely with each mailbox provider. Signume shall not be liable for any failure, delay, inconsistency, or change in logo or checkmark display by any mailbox provider, including providers that displayed the logo at the time of delivery and later changed their policies, algorithms, or requirements.

Privacy

Your privacy is very important to us. We designed our Privacy Policy to make important disclosures about how we collect and use your content and information and how you can control it. We encourage you to read the Privacy Policy carefully.

Acceptance of Terms

By registering for and/or using the Services in any manner, you agree to these Terms and all other operating rules, policies, and procedures that may be published from time to time on the Site by us, each of which is incorporated by reference.

Modification

We reserve the right, in our sole discretion, to modify or replace any of these Terms, or change, suspend, or discontinue the Services at any time.

Registration

You may need to register for an account to access some or all of our Services. You agree to provide accurate, current, and complete account information and to maintain and promptly update this information.

Security

While we work to protect the security of your content and account, we cannot guarantee that unauthorized third parties will not be able to breach our security measures.

User Content

We may, in our sole discretion, permit users to post, upload, publish, submit, or transmit content. By making available any content on or through the Services, you hereby grant to Signume a worldwide, irrevocable, perpetual, non-exclusive, transferable, royalty-free license to use the content, subject to our privacy policy.

Intellectual Property Rights

The Services are protected by copyright, trademark, and other laws. Nothing in the Terms gives you a right to use the Signume name or any of the Signume trademarks, logos, domain names, and other distinctive brand features.

Feedback

We appreciate your feedback, ideas, or suggestions, but you acknowledge that we may use them without any obligation to compensate you for them.

Indemnity

You will indemnify and hold harmless Moonlab B.V. (operating as Signume), its officers, directors, employees, and agents, from and against any claims, disputes, demands, liabilities, damages, losses, and costs and expenses, arising out of or in any way connected with your access to or use of the Services.

No Warranty

The Services are provided on an "as is" and "as available" basis. Signume makes no warranty or representation on the completeness, security, reliability, quality, accuracy, or availability of the Services.

Limitation of Liability

In no event will Moonlab B.V. (operating as Signume), its affiliates, or their licensors, service providers, employees, agents, officers, or directors be liable for damages of any kind, under any legal theory, arising out of or in connection with your use, or inability to use, the Services.

Governing Law and Jurisdiction

These Terms shall be governed by the laws of The Netherlands, without regard to its conflict of law provisions.

Dispute Resolution

You and Signume agree to arbitrate any dispute arising from these Terms or relating to the Services, except that you and Signume are not required to arbitrate any dispute in which either party seeks equitable relief for the alleged unlawful use of copyrights, trademarks, trade names, logos, trade secrets, or patents.

General Terms

If any part of the Terms is held invalid or unenforceable, that part will be construed to reflect the parties' original intent, and the remaining portions will remain in full force and effect.

These Terms make up the entire agreement between you and Moonlab B.V. (operating as Signume), and supersede any prior agreements. This agreement is effective from the date that you first access the Services or submit any information to Signume, whichever is earlier, and will remain effective until terminated in accordance with its terms. Certain provisions of this agreement that, by their nature, must survive termination of this agreement, will survive termination. By using our Services, you acknowledge that you have read and understood these Terms of Service and will comply with them. We may revise these Terms of Service from time to time. Please note that these Terms, its subject matter and its formation, are governed by Dutch law. You and we both agree that the courts of The Netherlands will have exclusive jurisdiction.
